FAMILY REUNIFICATION of a foreigner with a permanent residence permit in Bulgaria with a financially secure parent

Residence permit in Bulgaria can be received by financially secure parents whose children have Permanent Residence/Residence or bOlgar Citizenship.

Thus, there are regulatory requirements of the procedure and conditions according to which foreigners can enter, stay and leave the Republic of Bulgaria. These requirements and conditions are defined by the Law on Foreigners in the Republic of Bulgaria (LBIA) and the Regulations for the Implementation of the Law on Foreigners in the Republic of Bulgaria (LBRI).

We have already written that a foreigner wishing to stay for a long, permanent or long-term period in the territory of the Republic of Bulgaria needs get a D visa according to Article 15, Part 1 of the Law on Foreigners in the Republic of Bulgaria (ZIRB). According to Article 9, Part 1 of the Regulation on the Conditions and Procedure for the Issuance of Visas and the Determination of the Visa Regime, a long-term visa for a period of 6 months and the right to reside on it for 180 days is issued to a foreigner wishing to stay in the Republic of Bulgaria for a long time or permanently.

An application for a long-term visa is submitted only at the diplomatic and consular missions at the place of residence of the candidate or at those missions that are accredited by the country of permanent residence of the candidate. An application for a visa is submitted in the form according to Appendix No 2, no earlier than 3 months before the expected date of entry.

When applying for a long-term D visa, there are no exceptions to the requirement to appear in person.

In accordance with Article 11 of the Regulation on the Conditions and Procedure for the Issuance of Visas and the Determination of the Visa Regime, the Ministry of Foreign Affairs, as well as the Diplomatic and Consular Missions of the Republic of Bulgaria provide free and publicly available information on the conditions and procedure for submitting applications for the issuance of visas.

And now for a residence permit in Bulgaria for financially secure parents:

In order to apply the legal basis (Article 24, Part 1, Paragraph 7 of the LRI), in accordance with Article 14, Part 1 of the PPIRB, in order to obtain the right to long-term residence, a foreigner personally submits an application to the Directorate "Migration" or the Regional Directorate of the Ministry of Internal Affairs in the form in accordance with Appendix No 3, to which he attaches:

1. A copy of a valid passport or a document that replaces it, with pages with a photo, personal data, a visa in accordance with Article 15, Part 1 of the ZIRB, if required, and a stamp of the last entry into the country; to verify the identity of the copy, the original passport or a document that replaces it shall also be submitted;

2. a document confirming the payment of the state fee in accordance with Article 10, Part 3 of the Tariff No 4 on fees that are collected in the system of the Ministry of Internal Affairs in accordance with the Law on State Fees, except for foreigners who submit documents on the basis of Article 24, Part 1, Paragraphs 5, 13 and 18, Article 24c, Article 24i and Article 33g, Part 4 of the Law on State Fees, if the payment is not made electronically;

3. Evidence of housing;

4. compulsory health insurance valid on the territory of the Republic of Bulgaria, if the person is not insured under the Law on Health Insurance;

5. proof of the availability of stable, regular, envisible and sufficient means of subsistence, without recourse to the social security system, in an amount not lower than the minimum monthly wage, minimum scholarship or minimum pension in the country, for the period of stay on the territory of the Republic of Bulgaria;

6. Police clearance certificate issued in the country of which the foreigner is a citizen, or in the country of his/her regular residence – at the initial submission of the application.

7. Birth certificate of a family member of the younger generation in cases where he is a foreign citizen.

Evidence of the existence of housing must be submitted in accordance with § 1, paragraph 20 of the Additional Provisions of the Law on Foreigners in the Republic of Bulgaria.

In another case, it is possible to apply the provision regulating the possibility for foreigners to obtain the right to long-term residence in the Republic of Bulgaria on the basis of Article 24, paragraph 1, paragraph 10 of the Law on Foreigners in the Republic of Bulgaria, who: "have acquired the right to a pension, in accordance with the legislation of the Republic of Bulgaria, in the country of origin or in another state, and have sufficient means to live in the country".

According to Article 23 of the PPNIRB, in order to obtain the right to long-term residence on the basis of Article 24, Part 1, Clause 10 of the LRA, a foreign person submits documents in accordance with Article 14, Part 1 of the PPNIRB, as well as a document issued by the competent authorities of the relevant state, which certifies that the person has acquired the right to a pension, and a document issued by a bank on the territory of the Republic of Bulgaria, which certifies that there is an open account to which the relevant pension payments will be received.

An application for a residence permit under Article 14, Part 1 of the ZIRB is submitted to the Migration of Bulgaria no later than 14 days before the expiration of the permitted period for the stay of a foreigner on the territory of the Republic of Bulgaria. The application is considered and resolved within 14 days.

In order to certify the facts and circumstances on their legal basis, foreigners must submit originals or notarized copies of documents, in accordance with Article 62, Part 1 of the PPNIRB.
