Obtaining a residence permit in the Republic of Bulgaria (long-term stay) on the basis of "Family members of a foreigner who has received a long-term residence permit"
We have written this article for those who are going to come to Bulgaria on a D visa and then obtain a residence permit through the "Family Reunification" procedure.
Close relatives of a foreigner (spouse, minor children under 18 years of age) who already have a Residence permit , or DVJ/Permanent Residence on the basis of Article 24 paragraph 1 paragraph 13 "Law on Foreigners in the Republic of Bulgaria" (ZCHRB) can obtain a long-term residence permit in Bulgaria for up to 1 year.
Spouse and minor children under 18 years of age who have not married have the right to family reunification.
A person who already has a residence permit (long-term stay) in Bulgaria and wants to ensure the stay of his close relatives in the country is called Titular, and members of his family – Dependents.
Obtaining a residence permit in Bulgaria for "Dependent persons" – close relatives takes place in stages:
First, a residence permit is obtained by one of the family members ("Titular", "main holder") for any of the grounds under the current Aliens Act.
After that, the "main holder" of the residence permit submits an application for "family reunification" (molba) and documents for obtaining permission for family reunification to the Bulgarian Migration Service.
A month later, we receive a decision on family reunification.
The next step is to obtain a type D visa at the Embassy of the Republic of Bulgaria located on the territory of your country of residence.
And the last, final stage of this procedure is obtaining a long-term residence permit (residence permit) from the Bulgarian Migration Directorate.
The period of long-term stay cannot exceed the actual period of residence permit held by the "main holder" (Titular Holder).
Consideration documents and Applications for "family reunification" in the Migration Directorate – 1 month.
The fee for applying for family reunification is 10 BGN for each family member.
The validity of the Family Reunification Decision is 6 months.
After obtaining a permit for a long-term stay in Bulgaria, your family members return to the country of residence and apply for a D visa at the Bulgarian Consulate.
A type D visa is issued under a simplified procedure within two weeks.
Consular fee for a type D visa is 100 euros (children under 6 years old are free of charge).
IMPORTANT!
At the time of submitting an application for family reunification to Migration The titular (the main holder of the residence permit) must have a permitted period of stay in Bulgaria (residence permit) – one year.
From our practice:
The Migration Directorate will not accept documents if the residence permit is valid for Titular is equal to or less than six months.
