Residence permit in Bulgaria on the basis of Family reunification with a Bulgarian citizen

This article is useful for those who are going to get Residence permit in Bulgaria, having a marriage with a Bulgarian citizen. This ground is described in Article 24, paragraph 1, paragraph 18 "Law on Foreigners in the Republic of Bulgaria". The law states that the status of a residence permit can be obtained by foreigners who are family members of a Bulgarian citizen. Recall that according to Bulgarian law, not only spouses, but also children under 18 years old are considered family members. Family members of a Bulgarian citizen who have received a residence permit in Bulgaria have their own advantages: For example, a residence permit on this basis gives a family member the right to work for hire, and when obtaining Bulgarian citizenship, the spouses do not have to renounce their first citizenship – they can keep both. In this case, the period of residence in Bulgaria with permanent residence or residence before obtaining citizenship is reduced to three years. So, what do you need to do to get the right to reside in Bulgaria on this basis? What actions should be taken? First stage: Production D Visas at the consulate in your country of residence Here is a list of required documents: 1. A passport valid for at least 18 months from the date of submission of documents, containing at least two blank pages and not older than ten years; 2. A copy of the first page of the passport (spread with a photo and personal data); 3. Completed visa application form (1 pc.), filled out legibly and signed by the departing person himself; 4. An up-to-date color photo of the applicant (1 pc.), passport size 3.5×4.5 cm., on a light background, taken no later than 6 months ago, with a clear image of the full face without glasses with tinted lenses and without a head covering; 5. Persons who have reached the age of 18 (except for stateless persons) must provide a certificate of criminal record (original and notarized translation). A criminal record certificate is valid for 6 months, but must be valid for at least another 1 month at the time of submission; 6. A copy of the personal card or passport of the Bulgarian citizen; 7. A notarized application on behalf of a Bulgarian citizen on the financial and social security of a person for the period of residence in the Republic of Bulgaria (or medical certificates on the presence of diseases) – upon presentation of the application, a certificate of financial support is not required; 8. A notarized declaration from the owner of the home, if the housing is rented; 9. Health insurance with coverage of 30000 euros; 10. Birth Certificate – for persons under the age of 21 (original and notarized translation + photocopies) or Marriage Certificate registered in Bulgaria (original and notarized translation + photocopies) Important! If the marriage with a Bulgarian citizen was concluded in another country, the marriage certificate must be registered in the Community of the city where the Bulgarian document will be issued. The registration period is 3 days. Second stage: Obtaining a residence permit in Bulgaria Not later than 3 weeks before the expiry of the D visa, the family members of the Bulgarian citizen must come to Bulgaria and submit documents for the Residence permit to Migration in the city at the place of residence. The same documents must be submitted to the Migration Department as for a long-term migration visa D in order to obtain a residence permit. The residence permit fee for this category of foreigners is BGN 150 per year. And so for 5 years. Third stage: Production Permanent Residence (or Residence Permit) After 5 years of living in Bulgaria with the status of "Extended Stay" (Residence Permit) Family members of a Bulgarian citizen can obtain a permanent or long-term residence permit in the country. To obtain permanent residence, the amount of the state fee is 150 leva, To obtain a residence permit – 110 leva. ATTENTION! EIf a child is born in the family – a Bulgarian citizen, then in order to obtain permanent residence/residence permit, it is enough to live in Bulgaria with a residence permit for 3 years.
